Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Baanmatch ("Baanmatch", "we", "us") governing your use of the Baanmatch platform, a two-sided recruitment marketplace connecting candidates and companies. By creating an account or otherwise using the platform, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Baanmatch.

1. Eligibility

You must be at least 16 years old and legally able to enter into a contract to use Baanmatch. If you use the platform on behalf of a company or other organisation, you confirm that you are authorised to bind that organisation to these Terms, and "you" refers to that organisation.

2. Accounts

You must provide accurate, current, and complete information and keep your account credentials secure. You are responsible for all activity that happens under your account, and you must notify us promptly of any unauthorised use. Each account is for either a candidate or a company, as selected during onboarding, and may not be shared or transferred.

3. The service

Baanmatch provides tools for candidates to build profiles and offer services, for companies to post vacancies and search candidates, and for both sides to connect through consent-based messaging. Baanmatch is a neutral venue: we are not an employer, employment agency, or party to any agreement, interview, or engagement that results from contact made through the platform.

4. Fees

Baanmatch is currently free to use. If we introduce paid features in the future, we will make the applicable pricing and terms clear before you incur any charge, and your continued use of a paid feature will be subject to your acceptance of those terms.

5. Acceptable use

You agree not to post unlawful, misleading, discriminatory, or fraudulent content; not to harass, spam, or impersonate others; not to scrape, harvest, or resell data from the platform; and not to attempt to circumvent security, access controls, or rate limits. Vacancies and services must represent genuine, lawful opportunities and comply with applicable non-discrimination and labour laws.

6. Vacancies, services & applications

Companies are responsible for the accuracy and legality of the vacancies they post, and candidates are responsible for the accuracy of their profiles, CVs, and applications. Any offer, contract, salary, rate, or working condition is agreed directly between the candidate and the company. Baanmatch does not verify the identity, qualifications, or representations of any user and gives no guarantee that any application will lead to an interview or engagement.

7. Messaging

Messaging is intended for genuine recruitment-related communication between users who have consented to connect. You may not use messaging to send unsolicited advertising, harmful content, or anything unrelated to a professional opportunity. We may limit, review, or remove messages that breach these Terms.

8. Your content

You retain ownership of the content you upload (profiles, CVs, vacancies, services, messages). You grant Baanmatch a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display that content as needed to operate and provide the platform. You confirm you have the rights to the content you upload and that it does not infringe the rights of others.

9. Intellectual property

The Baanmatch platform, including its software, design, and branding, is owned by Baanmatch and protected by intellectual property laws. We grant you a limited, revocable, non-transferable licence to use the platform in accordance with these Terms. You may not copy, modify, or create derivative works of the platform except as permitted by law.

10. Privacy & data

We process personal data in accordance with our Privacy Policy, which explains what we collect and your rights under the GDPR (AVG). By using Baanmatch you acknowledge that candidates and companies will be able to view certain profile information as part of the platform's core discovery features.

11. Moderation

We may review content and accounts to keep the platform safe. We may hide vacancies or services, and suspend or delete accounts, that violate these Terms or applicable law, at our reasonable discretion. Where practical we will give notice, but we may act immediately in cases of serious or repeated breaches.

12. Termination

You may stop using Baanmatch and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the service. On termination, the licences you granted for content already shared with other users may persist to the extent needed for their legitimate use, subject to the Privacy Policy.

13. Disclaimer

Baanmatch is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee employment outcomes, the accuracy of listings or profiles, the conduct of users, or that the platform will be uninterrupted or error-free. Hiring decisions and agreements are solely between candidates and companies.

14. Limitation of liability

To the fullest extent permitted by law, Baanmatch is not liable for any indirect, incidental, or consequential damages, or for any loss of profits, opportunities, data, or goodwill arising from your use of, or inability to use, the platform, or from any interaction between users. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date and, where appropriate, notify you. Continued use of the platform after changes take effect means you accept the updated Terms.

16. Governing law & disputes

These Terms are governed by the laws of the Netherlands. Any disputes will be subject to the competent courts of the Netherlands, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be replaced by a valid one that most closely reflects the original intent.
